Privacy Collection Notice

This privacy collection notice from Lamplugh McIntosh Lawyers Pty Ltd outlines why we collect your personal information, what we collect, how we collect it and who we share it with.

This notice applies only to personal information handled in connection with our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act) and the Anti-Money Laundering and Counter-Terrorism Financing Rules 2025 (Rules).

Why we need to collect your information

We collect your personal information to comply with the ‘Customer Due Diligence’ requirements in the AML/CTF Act and Rules. This includes to:

  • establish and verify your identity before providing certain services to you or the person you are acting on behalf of

  • assess and manage potential money laundering, terrorism financing, proliferation financing risks or related compliance risks associated with the provision of our services

  • make reports required by law under the AML/CTF Act and Rules

  • meet record keeping obligations under the AML/CTF Act and Rules ‍

What personal information we collect

We collect the following types of personal information:

  • full name, date of birth, residential address, phone number and email address

  • country of citizenship and residence

  • photo ID and unique identifier, such as a passport or driver’s licence number

  • income and occupation

  • whether you or a close associate are or has been a politically exposed person

  • whether you are or have been subject to regulatory or law enforcement action

We may also collect the following sensitive information:

  • Whether you are a member of any political associations, professional or trade associations 

  • Whether you have a criminal history

How we collect your information‍ ‍

We will generally collect your personal information by requesting it from you directly, and from publicly available information sources such as websites, Australian Securities and Investment Commission, government bodies, land registries or search engines

Who we may share your information with

  • We may share information with:

  • third parties with your express permission;

  • barristers or third parties you instruct us to engage in the provision of services to you;

  • contracted service providers to organise or facilitate the efficient and effective administration, management or delivery of our services; and

  • as otherwise permitted or required by law, including the Privacy Act.

We may also share your personal information with AUSTRAC to meet our legal and regulatory obligations under the AML/CTF Act or Rules.

We take reasonable steps to ensure overseas recipients do not breach the APPs. ‍

What happens if we cannot collect your information

‍If you do not provide us with your personal information, we may not be able to verify your identity and provide you (or the person you are acting on behalf of) with the services you have requested.
